الديموقراطية والقانون : علاقة وضرورة

يقترن توافر القانون بحضور المجتمع - أي مجتمع - فضلاً عن اقتران السلطة بها، لأن السلطة هي التي تقوم بسن القوانين عبر مجالسها النيابيَّة ، سيما في ظل النظم السياسية الديموقراطية، وإذا كان القانون ضروريًّا لحياة الأفراد ومن أجلِّ تنظيم الحياة الاجتماعية ، فإنَّه يشكِّل قيداً عليهم؛ لأنَّ حرية الفرد تحتل ركناً أساسيًا في الحياة الديموقراطية، من هنا ينشأ التعارض بين القانون والحرية, اي ينشأ التعارض ما بين القانون والديموقراطية. فكيف تتماهى فكرة القانون مع فكرة الديموقراطية ؟
