المُلَخص:
لم يَغفل الآباء المؤسّسون عند تأسيسهم نظاماً سياسيّاً ديمقراطيّاً في الولايات المتّحدة الأمريكيّة في جعل الأسس الدستوريّة والقانونيّة مرتكزاً أساسيّاً في توجيه سياساته، لذلك عمدوا إلى تأسيس هيأة قضائية تُعنى بجعل أنشطة النظام تنساق على وفق المنهج الدستوريّ والقانونيّ، وجعل منح شرعية العمل بالقوانين والقرارات معنيّة بموافقتها، تُجسّد ذلك من خلال تفسير مواد الدستور، وتحديد مدى دستورية القوانين والقرارات، فضلاً عن ذلك جعلها محطّ تحكيم في الاختلافات التي تحدث بين مؤسسات النظام بمستوييه الاتّحاديّ والمحليّ، ولا يتوقف على ذلك ,بل تشمل الأفراد أيضاً، فهي بذلك عامل ضبط وتوجيه تتجسد في التأثير في صنع السياسات العامة للنظام السياسيّ الأمريكيّ.
